Anmerkungen | "Conclusion: After a complete review of the available evidentiary materials, Mr. Waldheim's submissions and applying established legal principles, we have no doubt that during World War II, while serve as a Wehrmacht Officer in the Balkans, Kurt Waldheim assisted or otherwise participated in persecution because of race, religion, national origin or political opinion. Moreover, Mr. Waldheim has failed to rebut the case against him or otherwise demosntrate that he did not engage in activities which fit within the purview of 8 U.S.C. §1182 (a) (33). Indeed, if Mr. Waldheim were in this country, OSI would speek approval to institute deportation proceedings on the basis of such activities; we are confident that we would be successful in any such legitimation."
